社会变迁与法治演进

法律秩序内生于社会结构,与社会的其他维度交织在一起,共同构成完整的社会秩序。社会变迁必然引发作为其内在结构的法制的变动,无论是经验还是逻辑都证明了这一点。同时,法制的演进又在一定程度上形塑着社会形态,推动着社会变迁,甚至构成了社会变迁最主要的标志。中国的法治建设是在社会急剧转型之下的作业,必须将其置于现代化的视野之下,才能深刻理解法治的社会和政治意义。

Social Changes and the Evolution of Rule of Law

The legal order is born inside social structure and integrated with other aspects of society to form the complete social order. The social changes will lead to the evolution of rule of law, which has been witnessed by both the experience and logic. Meanwhile, the evolution of rule of law will, to some degree, help shape the social forms, prompt the change of society and thus be the significant landmark of social evolution. The construction of rule of law in China is a task under the dramatic changes of society, therefore it is necessary for us to put it in the background of modernization to understand its social and political meaning profoundly.
