公安机关执法"黑洞"的解读及遏制对策

当前公安机关执法活动中存在不少问题,可称之为执法"黑洞".主要有四类表现执法程序上的随意性;执法手段上的违法性;执法裁定上的主观性;执法形象上的趋劣性.究其原因不外乎四种因素传统观念的影响;外界压力的左右;激励约束的缺失以及整体素质的不均衡.执法"黑洞"的存在,严重影响公安机关乃至党和政府的形象,制约了公安机关职能的充分发挥,必须采取过硬措施予以遏制.

Interpretation of the "Black Hole" of Law Enforcement of Public Security Organs and Containing Counter-measures

There exists many problems of law enforcement of public security organs,which is called"black hole"of law enforcement.It has four main features:the arbitrariness of law enforcement procedure,the illegality of means of law enforcement,the objectivity of the adjudication of law enforcement,and the abominability of image of law enforcement.The causes of these are as follows:the influence of the traditional conception,the influence of the outside pressure,the shortage of discipline and the unbalance of the whole staff's quality.It has such a bad effect on the image of public security organs,even our party and government,that the function of public security organs has been badly restrained.In view of this,effective measures must be taken to make up the "black hole"of law enforcement.
