国际货物买卖中,货物所有权转移与买卖双方的基本权利的实现关系密切,与一方当事人破产后,另一方当事人权利的实现以及货物风险的承担密切相关。但是,各国在所有权转移的法律规定上存在严重分歧,这严重阻碍世界经济的发展。制定统一的所有权转移的实体法公约因此势在必行。
