| 摘 要： | 人身损害行为带来的损害赔偿责任分为人格利益补偿与财产性利益的补偿。我国人身损害赔偿制度对于人格下经济利益的补偿在认定标准上的地域差异，使民事主体并不能得到完全的补偿。人格利益精神损害赔偿制度的不完整也造成民事主体精神损害得不到赔偿。

| Abstract: | The damage compensation caused by personal injury behavior includes the compensation of personal interests and property interests. The system of personal injury damage compensation is different in different areas. The civil subject cannot get the complete compensation by different standards, the civil subject also cannot get the moral damage compensation by the incomplete system. |
