| 摘 要： | 商业贿赂涉及到刑法中的八种罪名,这些罪名的法定刑具有以下突出特点：主刑规定的种类多且挂有死刑,罚金刑缺失、没收财产刑适用范围太窄,针对不同主体配置差异极大刑罚。对国家工作人员、国有单位配置了明显重于非国家工作人员、非国有单位的刑罚,对单位的刑罚配置明显轻于自然人。商业贿赂犯罪的现有资格刑规定无法有效防控商业贿赂。
