公私合作背景下的代履行——以行政强制法草案相关条文为分析对象

代履行是一种比较广泛使用的间接强制执行方法,但目前在理论界与实践中并未形成统一的认识。只有没有利害关系的第三人代为履行才是真正意义上的代履行,在紧急情况下的行政机关代为履行则属于直接强制执行。从公私合作的背景来看,第三人与行政机关之间是民事合同关系。代履行的实质是公与私之间的优势互补,充分发挥了行政机关、社会组织、企业在社会治理中各自的优势。
