劳动争议协商处理机制研究

摘    要:随着市场化、全球化步伐的加快,与市场经济同处于转型期的劳动关系,正处于巨大的制度变迁时代。当前我国现有劳动法律体系的形成,为解决劳动争议提供了配套的法规依据。劳动争议既是劳动关系主体之间的一种对抗性矛盾,也是一种非对抗性矛盾。劳动争议的矛盾固然可以转化,然而,当事人任何一方的不当行为,往往促使矛盾激烈化。因此,把当事人之间的协商机制作为解决劳动争议的基础性程序,坚持协商原则,加强工会的自身建设,发挥企业在预防、协商处理劳动争议中的作用,十分重要。

Abstract:With acceleration of marketization and globalization,the labor relation at the same transition period as market-oriented economy,is witnessing the tremendous system change.Establishment of current labor legal system has provided the supporting legal basis for settlement of labor dispute.The labor dispute can be either the confrontational contradiction or non-confrontational contradiction.No doubt,this contradiction of labor dispute can be transformed,but the improper conduct of any party may intensify this contradiction.Therefore,it is very important that how to take the negotiation mechanism between parties as the fundamental procedure for settlement of labor dispute following the negotiation principle,intensify self establishment of labor union and exert the role of enterprise in prevention,negotiation and settlement of labor dispute.
