《保护水下文化遗产公约》评析

水下文化遗产保护是海洋法领域的一个新课题,随着科技的发展和时代的进步,人类的研究和开发空间越来越广阔,但这些活动同时引发了很多弊端,对水下文化遗产的严重破坏便是其中之一。联合国教科文组织于2001年11月2日通过的《保护水下文化遗产公约》于2009年1月初正式生效,该公约是迄今为止国际社会最为全面、系统地保护水下文化遗产的专门公约,其对于水下文化遗产的明确和科学界定、对于水下文化遗产的全面保护机制以及其关于争端解决的多样化规定等都极具开拓性,为更好地规范水下文化遗产的保护提供了全面、科学的法律依据,值得我们认真研究。
