法官独立行使审判权探析

法官是法院行使审判权的主体 ,法官独立行使审判权是法院审判权独立的内在部分 ,是审判独立的核心。法官独立行使审判权作为一项宪法原则和国际性司法原则 ,是实现法治和树立审判权威的要求。我国现有的审判模式妨碍了法官独立审判权的行使 ,阻碍了法官制度改革的进程。借鉴其他国家的成功经验 ,从制度上完善我国的审判制度 ,保障法官对审判权的独立行使 ,是我国审判体制改革不可回避的关键问题。

Analysis on Judge''s Indenpendent Exercise Over Jurisdiction

Judges are the sublject exercising jurisdiction in courts.Judge's independent exercise over jurisdiction is the inner part of independence of court jurisdiction,is the core of independent trial.As a constitutional principle and an international judiciary principle,it is demanded for the rule by law and the establishment of the authority of the trial.However,the present trial mode in China prevents it and the reform of judge.Learning from other countries'successful experience,the key problem is to improve the system of trial,guarantee judge's independent exercise over jurisdiction,which is also inevitable.
