论我国惩罚性赔偿制度的发展与完善

《中华人民共和国食品安全法》第96条第2款规定了数额为食品价款十倍的惩罚性赔偿金。与美国限制惩罚性赔偿适用的趋势相比，我国惩罚性赔偿却呈现扩大适用的趋势。从1993年《消费者权益保护法》首次规定惩罚性赔偿制度至今，我国惩罚性赔偿制度适用的范围日益扩大，赔偿金数额逐步完善。但在归责原则、赔偿数额的确定、适用范围等方面还存在一定问题。应该进一步完善惩罚性赔偿的归责原则，扩大数额的幅度，扩大惩罚性赔偿的适用范围。

On Development and Consummation of the Punitive Damages System in Oar Country

The 2nd section of the 96th item in the Food Security Act of the People＇ s Republic of China has stipulated the punitive indemnities for ten times of the food cost. Compared with the limitation tendency of the punitive damages in the USA, the punitive damamges in our country actually presents the expanded tendency. From the appearance of the punitive damamges system in the Consumer Rights and Interests Protection Act of 1993 for the first time, the suitable scope of the punitive damages system of our country expands day by day, the indemnity amount consummates gradually. However, there are still some problems in responsibility attribution principle, damages amount determination, application scope, etc.. We should further consummate the responsibility principle of the punitive damages; expand the amount scope, and the application scope of the punitive cdamamges.
