中国语境下的死刑问题探讨

自贝卡里亚以来，死刑存废问题就成了理论界的宠儿，被讨论的轰轰烈烈。不仅是外国，中国理论界也是热衷于此。其中，废止死刑的呼声相当高涨。死刑在长远意义上应当废止，但是，对此我们应当谨慎。当今中国并不具备废止死刑的条件，在现阶段的中国必须保留死刑，同时予以限制。文章首先反驳死刑废止论的代表性观点，从反面立论；再从正面论证现阶段保留死刑的必要性。在此基础上，提出死刑限制的完善建议，以使死刑在现阶段的适用中发挥最大的威力。

On Death Penalty Under Chinese Linguistic Environment

Since Beccaria, the argument on the retention or the abolition of the death penalty has become the darling of the theoretical circles. The phenomenon not only exists in foreign countries, but also in China. Of the two viewpoints, the call for the Abolition of the death penalty is strong. From the long-term perspective, the death penalty should be abolished. To China, however, we should be cautious about the agenda. At present, China is not well prepared for the Abolition of the death penalty. Therefore the death penalty in China should be maintained, meanwhile, restricted. The thesis first from the opposite argument refutes the typical views on the abolition of the death penalty, and then directly proves the necessity of retaining the death penalty at this stage. Based on the previous arguments, the thesis presents concrete proposals for perfecting restrictions on the death penalty, so that the application of the death penalty at this stage acts a positive role and exerts the maximized legal effect.
