妨害信用卡管理罪的客观特征分析

《中华人民共和国刑法修正案(五)》规定了妨害信用卡管理罪,将持有、运输、出售伪造的(空白)信用卡等行为犯罪化,有效地弥补了信用卡犯罪刑事法规的不足。但要在司法实践中准确地适用本罪,则必须对其客观特征进行准确的分析,即对“明知是伪造的信用卡而持有、运输的”中的“持有”、“运输”,对“非法持有他人信用卡,数量较大的”中的“非法”和“数量较大”,以及对“使用虚假的身份证明骗领信用卡的”中的“虚假身份证明”等,进行正确的分析和界定。

The Objective Analysis of Crimes of Impeding Management of Credit Card

The Fifth Amendment of Criminal Law of People's Republic of China stipulates the crime of impeding management of credit card and defines such behaviors as possessing,transporting and selling forged credit cards as crimes,which effectively supplies the deficiency in criminal net of justice of credit card crimes.However,applying the crime in judicial practice exactly requires accurate analysis of its objective qualities,namely properly analyzing and defining the "possessing" and "transporting" of "possessing and transporting known forged credit cards",the "illegal" and "large quantity" of "illegal possessing others' credit cards in large quantity",as well as the "false identity certificate" of "defrauding credit cards by using false identity certificate".
