论同工同酬权的法律保护

摘    要:同工同酬权是一项基本人权.坚持同工同酬原则有利于促进社会平等、协调劳资关系与建设和谐社会.同工同酬建立在"同工"、"同酬"的基础上.同工同酬包括同值工作同酬,也允许劳动报酬的合理差别.中国同工同酬立法尚不完善,应从立法、行政、司法三个角度加强同工同酬权法律制度建设,强化劳动者同工同酬权的法律保护.

Abstract:Equal pay for equal work is a basic human right.Adhere to the principle of equal pay for equal work is conducive to the promotion of social equality,coordination of labor relations and building a harmonious society.Equal pay for equal work based on "equal work"and "equal pay" basis.It is not only including equal pay for work of equal value,but also allow a reasonable remuneration difference.China equal pay for equal work legislation is not perfect,so we have to strengthen the legal system and the legal protection to the right of equal pay for equal work from the legislative,executive and judicial point of view.
