完善检察机关内部监督制约机制研究

检察机关是国家法律的监督者,其代表国家行使法律监督权。但根据权力的监督与制衡理论,＂绝对的权力必然导致腐败＂,因此,必须强化检察权的内部监督,以减少或杜绝检察机关内部的执法腐败现象。文章欲通过对检察机关内部监督实践问题的深入分析,总结问题产生的原因,探求完善检察机关内部监督制约机制的合理样态,以进一步树立检察机关公正、文明执法的良好形象,加强人员队伍廉政建设,从根本上惩治和预防内部腐败。

Research on Perfecting the Internal Supervision and Restriction System of the Prosecution

Procuratorate is the national legal supervision organ, which represents the state to exercise the right of legal supervision. But according to the theory of the power supervision and balance,＂absolute power will result in corruption＂. Therefore, we must strengthen the internal supervision of the procuratorial power to reduce or eliminate the corruption in the law enforcement. Through this article, the authors want to get in-depth analysis of the causes over the problems in practice and in order to seek a reasonable state about the improvement of the prosecutorial internal supervision mechanism. Then we can further establish procuratorate, justice, civilized image on the law enforcement and strengthen the honest and clean team construction. Finally, we must solve the problem of the internal corruption in the prosecution.
