| 摘 要： | 随着市场经济的发展,越来越多的交易是通过招标和拍卖这样的竞争性交易方式实现的。但在我国的实际生活、司法实践甚至是立法上都没有很好地区分这两种交易方式,这给法律适用带来了很大的困难,也不利于这两种竞争性交易方式的发展。招标与拍卖的区别,体现在性质、标的、程序的不同上,目前存在滥用招标这一概念和程序的现象,目前已有的涉及招标与拍卖的法律应当进行修改。

| Abstract: | With the development of market economy, the competitive of trading methods bidding and auction are more and more popular among all the trade forms but have not been distinguished practically and legislatively and judicially which brought lots of difficulties in law application and its development. Bidding and auction are different in nature, subject and procedure and are abused and it is suggested that our public bidding and auction laws should be revised. |
