恢复性司法与和谐社会

构建和谐社会,已成为时下中国的一个重大时代主题,被称为“新的伟大长征”①。在这一理念指导下,刑事法治也可以从多方面予以改进。流行于当今西方社会的刑事司法新动向——恢复性司法,与构建和谐社会在理念方面有诸多契合之处:其比较全面地照顾到了有关当事各方,有利于建设和平社区;简化了犯罪的处理程序,采取经济的责任形式,大大降低了刑法的成本;有助于实现刑法预防犯罪的目的;有助于实现刑法保障人权的功能。

Restorative Justice and Harmonious Society

To construct a harmonious society,entitled with "A New Great Long March",has become a great subject of times in modern China.Under this notion,criminal rule of law can be improved from many sides.Restorative justice,a new tendency of criminal justice prevailing in present western societies,tallies with the concept of constructing harmonious society in many aspects: it shows comparatively full concerns for the relevant parties to help to construct peaceful communities;it simplifies the management procedure for crimes;it greatly reduces the cost of criminal law by adopting pattern of financial duties;it helps to realize the aim of crime precaution and realize the function of criminal law to guarantee human rights.
