| 摘 要： | 证券诉讼是随着证券市场的建立、证券纠纷频繁发生而相应产生的一种新型的现代型诉讼形式.但它只是一种专门诉讼形式,它的产生和发展有其法理上的依据.证券诉讼自身的种种特质为法律的适用增添了难度,同时对适用法律亦有特殊要求.

The emergence and development of this kind of litigation bears some nomological explanations. The specialties of securities action, which demands special requirements in applying the law, place additional difficulty on the application. |
