| 摘 要： | 我国《反垄断法》的宽恕制度缺少明确、具体的适用条件。本文针对宽免程度的不同，在区分免除处罚和减轻处罚两种宽恕类型的基础上，分别比较主要国家现代竞争争法对其适用条件的规定，归纳通用的基础条件，同时也指出部分国家或单一国家特有的条件，并在此基础上提出构建我国宽恕制度适用条件的设想。

| Abstract: | According to the varying degrees,there are two types of the leniency policy:immunity from punishment and reduction of punishment.Based on the applicable conditions of the competition law of the major countries,the paper relatively summarizes the basic conditions as well as the specific conditions.At last,the author makes several recommendations to perfect the leniency policy in China. |
