再论法治的价值

主流观点认为,法治的核心价值是人的尊严与自由。这是一个可以质疑的观点。在百年中国的历史上,法治的价值主要被理解为救亡与治乱;对于不同的主体而言,法治的价值与意义也是不一样的。要全面地理解法治的价值,有必要把法治的价值分为两个层面：直接价值与间接价值。

On the Value of the Rule by Law

The viewpoint of mainstram thinks that the core value of rule by law is people's dignity and liberty.This is a viewpoint that could be questioned.Over the past century,the value of ruling by law in China is interpreted as saving the nation from extinction and controlling disorder.To different subjects,values of rule by law are also different.If the value of rule by law should be fully understood,it should be stratified into two layers: direct value and indirect value.
