| 摘 要： | 在刑法理论中,对刑期折抵只是作为法律规定予以解读,而没有当作一项法律制度来把握。现行法律体系中,刑期折抵限定在先行羁押的范围,要求先行羁押与认定的犯罪事实基于＂同一行为＂,该标准没有全面考虑刑法自由保障机能,不能实现刑期折抵的真正价值。对此,应对刑期折抵标准予以重构。

| Abstract: | Criminal law theory just provides interpretation to sentence offsetting as legal provisions and does not take it as a legal system.In current legal system,sentence offsetting is limited in the range of first detention and requires that first detention and the facts of the crime being recognized should be based on the "same conduct".The standard does not take full account of protection function for freedom in criminal law and cannot realize the true value of sentence offsetting.Therefore,the standard of sentence offsetting should be reconstructed. |
