| 摘 要： | 刑事证明责任与举证责任、刑事证明责任的正置与倒置等相关概念之间的正确区分是分析我国刑事案件证明责任倒置问题的前提。举证责任是证明责任的第一重含义,二者既有联系又有区别;证明责任倒置本属于民事法律的规定,但在刑事法律中存在着证明责任正置与倒置的情况。

| Abstract: | The correct distinction among the relevant concepts of criminal burden of proof and proof-providing burden,the criminal burden of proof and its inversion is the precondition to analyze the problem of the inversion of criminal burden of proof in our country.Proof-providing burden is the first tier of meaning of burden of proof,and there are both connections and differences between them.The inversion of criminal burden of proof basically belongs to the provisions of civil law,but in criminal laws there are burden of proof and its inversion. |
