| 摘 要： | 羁押是指判决生效执行前的一种持续限制犯罪嫌疑人或被告人人身自由的特殊强制行为。它虽然在某种程度上保障了诉讼的正常进行,但对于人权的侵害却是非常严重的。文章分析了司法实践中在审查起诉阶段出现的隐形超期羁押的现状以及监督难的原因,并提出了解决对策。

| Abstract: | Custody is a special enforcement action that continuingly restricts the personal freedom of suspects or defendants before the effective implementation of judgment.Although it protects the normal conduct of litigation to a certain extent,it does great harm to human rights.The article analyzes the current situation of recessive extended custody existing in investigation and prosecution stage in judicial practice and the reason for difficult supervision,and provides countermeasures to resolve it. |
