| 摘 要： | 公诉机关在提起公诉时,首先要确定查明标准,即对犯罪嫌疑人有罪形成的心证达到何种程度;其次要确定证明标准,即公诉人对犯罪嫌疑人有罪的证明能使或者预计能使裁判者的心证达到何种程度。确定了查明和证明的标准,才能够提起公诉。

| Abstract: | When instituting prosecution,public prosecution first should determine the standard for identifying: how the evaluation of evidence for the suspect’s guilt is;secondly,public prosecution should determine the standard of proof: how the public prosecutor’s proof for the suspect’s guilt can or is expected to influence the judge’s evaluation of evidence.Only after determining the standard for identifying and the standard of proof can public prosecution institute prosecution. |
