| 摘 要： | 在＂汽车时代＂,醉驾和追逐竞驶行为即使未造成实际的实害结果,但因为其潜在的危害风险已经超出了社会容忍的边界,需要刑事立法进行调控。增设危险驾驶罪能有效弥补行政处罚之不足,实现刑法的一般预防;体现以人为本,立法为民。

| Abstract: | In "automobile age",drunk driving and pursuit of competitive driving,even if they have not caused actual harm results,should be regulated through criminal legislation because their potential hazard risks have exceeded the boundaries of social tolerance.Putting dangerous driving into the criminal can effectively make up for the deficiency of administrative penalties,realize the general prevention of criminal law,and reflect people-oriented and legislation for the people. |
