| 摘 要： | 宅基地使用权具有保障性、政治性与计划性,是一种特殊的用益物权。现阶段不宜开禁宅基地流转。宅基地上的房屋可以脱离宅基地使用权入市流转,建立专门系统的宅基地使用权制度规范体系,完善登记制度,从而解决宅基地初始取得和管理混乱的问题。

| Abstract: | The right to use homestead is protective,political,and planned,and it is a special right of usufructuary.At the present stage,it is inappropriate to lift the ban of circulation of homestead.The houses built in homestead can enter the market circulation out of the right to use homestead,set up specialized rules system of the right to use homestead,improve grading system,and solve the problem of initial acquisition of homestead and confusion in management. |
