信用卡犯罪的新特点及对策

本文所称“涉卡”犯罪包括信用卡犯罪和使用信用卡、储蓄卡犯罪。我国刑法规定的信用卡犯罪大致有三类 :伪造信用卡、信用卡诈骗、盗窃并使用信用卡 ;使用信用卡、储蓄卡犯罪具有信用卡犯罪的一般特征 ,但犯罪手段更为狡诈 ,涉及的犯罪种类更多 ,社会危害性加大 ,而司法机关对之却往往难以适用我国现有法律定罪量刑。“涉卡”犯罪随着科技的发展而产生、演变。目前 ,这一新型犯罪正呈日益严重之势 ,智能化程度不断提高 ,厦门市的情况就颇为典型。在打击对策上立案是关键性问题 ,各地公安机关应树立大局观念 ,联手合作 ,多警种协同作战 ;运用高科技手段 ,提高防控水平 ;进一步完善相关立法。

New features and countermeasures of credit card crimes

Card-related crimes include credit card crimes and crimes which concern the use of credit cards and savings cards. According to the criminal law in our country, credit card crimes can be categorized into three kinds: forging credit card, swindling by credit card and stealing and using credit card. In addition to some common features of credit card crimes, the latter shows other features such as the means are more tricky, more categories and do more harms to the society. However, it's hard for judicial organs to convict them or sentence them in the light of current laws. Now, card-related crimes in Xiamen are more and more serious. The countermeasures are that the public security organs of all levels should take the whole situation into account, cooperate closely, apply hi-tech to improving prevention, and further perfect relevant laws.
