新时代城管执法权法治化路径研究

新时代中国社会的主要矛盾需要通过国家治理体系和治理能力的现代化加以化解,城市化进程的加快使城市成为我国公民主要的栖居地,在城市诗意地栖居需要实现城市治理现代化,城市治理法治化是城市治理现代化的应有之义。实现城市治理法治化首要的是实现城管执法权法治化,城管执法权法治化要求以法治为路径实现城管执法权的明晰化和合理化。城管执法权的明晰化和合理化是保证城管执法权合法有效运行的基础。城管执法权的法治化有利于城管职能的实现和公民合法权益的保护;城管执法权的明晰化主要通过城管权力与公民权利边界的厘定,及城管权力与其它政府机关权力边界的界定和城管执法部门内部权限范围的勘定来实现;城管执法权的合理化主要通过城管执法权的社会化改造和司法化改造加以实现。
