| 摘 要： | 在继《消费者权益保护法》之后，《食品安全法》中再次引入惩罚性赔偿制度。本文分析了我国《食品安全法》中引入惩罚性赔偿制度的必要性和合理性的，明确了《食品安全法》第九十六条构成要件，然后根据学界对惩罚性赔偿制度及相关问题所进行的探讨，说明了该条文自产生之初就在可操作性、赔偿基数确定以及其实际作用等方面存在着很大的非议。本文在对这些非议进行分析的基础上提出了一些合理化建议。

| Abstract: | The system of the punitive damages is re-introduced in the ＂Food Safety Law＂ following the ＂Consumer Protection Law＂. Reviewing the origin of the punitive damages, its development and functional orientation, this paper analyzes of the necessity and rationality of introducing the system of the punitive damages. In addition, it explicitly insures the punitive damages as the 96th article of ＂Food Safety Law＂. Moreover, according to the discussing about these problems by academic community, this paper indicates the criticism between the maneuverability, compensation and practical effect about the system of punitive damages. Focusing on these criticisms, several rational proposals are advanced in this paper. |
