我国2010年《涉外民事关系法律适用法》中的属人法问题

我国《涉外民事关系法律适用法》经过多年的立法探讨和准备，终于在2010年10月28日通过并同时予以公布。该法的通过对于我国法律体系的完善具有重要意义，然而在具体制度的设计方面仍有不少值得探讨的地方。在属人法的具体规定上，该法大量采用“经常居所”作为首要、甚至唯一连接点，而作为属人法传统连接点的“住所”竞在此法中毫无踪迹可寻，“国籍”也是作为补充连接点而采用的。我国国际私法立法的这种“创新”之举无疑给我们留下了很大的探讨空间。
