摘    要:《劳动合同法》对离职竞业禁止经济补偿的合理确定未作规定,使得雇主约定不合理竞业补偿的普遍现象无法得到遏制,同时也不利于维持法律的稳定性和促进司法统一。我国可以借鉴德国法的相关制度解释和完善《劳动合同法》第23条,即明确合理的竞业补偿的计算基础及计算方法,并采取“双重标准”的制度设计以确保最终计算出的竞业补偿具有合理性,即以竞业补偿符合“法定最低标准”为原则,同时以其“不能不合理降低劳动者原有的生活水平”为补充。
