| 摘 要： | 立足于结果无价值论的旧过失论立场，过失就是对于客观的构成要件要素的认识与预见可能性，实务上理解的过失是注意义务违反，界定了其与旧过失论之间的关系，结果回避义务与客观的构成要件该当性相关，而作为责任要素，则应该要求对于引起构成要件该当事实的预见可能性与预见义务的违反。

| Abstract: | On the point of negligence of worthless consequence theory, this essay argues that negligence means possibility of recognizing and foreseeing to the objective element of Tatbestand, then criticizes theory of the present and the update negligence（ threatening feeling theory）. The writer points out that negligence at practical level is violation of care duty, and defines relationship between this kind of negligence and traditional negligence theory. This essay focuses on negligence offender＇ s elements after discussing two particular circumstances, which contains the allowed risk and negligence co-existence, it believes consequence avoiding duty relating to Tatbestand, however, Schlud＇ s essence is violation of Tatstand＇ s foreseeing possibility and obligation. |
