| 摘 要： | 党的十八届四中全会指出,探索建立检察机关提起公益诉讼制度。从检察机关的基本性质入手,立足我国基本国情,初步探寻检察机关在公益诉讼中扮演的角色。新设职能不必新设机构,探索建立以民事行政检察部门为主体、多部门联动的检察机关公益诉讼模式,是一条具有现实可行性的公益诉讼之路。
