| 摘 要： | 在司法实践中不服公安作出的劳动教养决定行政诉讼案件日益增多,公安机关败诉的表现形式多种多样,公安机关办理的劳动教养案件败诉的原因也是多方面的,对败诉的原因进行分析,能发现当前公安机关办理的劳动教养案件中存在的不少问题,提出减少和防治败诉的对策,有助公安机关提高办理劳动教养案件的水平和质量。

| Abstract: | The lawsuit of refusing to obey the decision made by the public security in reeducation-through-labor case is increasing in the practical actions.The cause and forms of the failed suit are various.We can discover many problems existing in the reeducation-through-labor case by analizing the cause of the failed suit.The solution to prevent and decrease the failed suit is helpful to improve the quality and level of reeducation-through-labor case made by public security organization. |
