| 摘 要： | 在台湾地区刑事诉讼中,在场权被视为律师一项独立的权利,具有重要的价值。台湾地区在司法警察、检察官及法官实行某些调查行为时均给予律师以在场权,同时设置一些例外,能够在保障人权与控制犯罪维持一种均衡,此外,与在场权相配套的程序设置也相对比较完善,值得学习与借鉴。
