我国婚姻登记制度之再思考

2003年出台的《婚姻登记条例》刻意去掉了原有的＂管理＂二字,以展现其立法定位是服务于民,大大弱化了婚姻登记机关的管理职能,而强化了登记当事人的自由和权利。近几年来,现实中的各种违法婚姻登记现象有增无减,这与管理的软弱、法律责任的缺失不无关系。本文结合现实分析了婚姻登记的性质,就婚姻登记审查权限、登记程序设计等方面的进一步完善提出了建议。
