英国普通法的历史基础--亨利二世前英国法对普通法形成的影响

普通法是英美法制当中一个独特的概念 ,也是当代各普通法系国家和地区法律制度重要的历史基础。近年来 ,随着我国与这些国家和地区交往的加深 ,普通法研究显示出其重要价值。然而 ,普通法研究在我国却长期未受到应有的重视 ,已有的研究却存在忽视其历史文化背景的重大缺撼。对此 ,本文主要从普通法的含义、历史地位及其两个重要历史形成基础方面探讨了这些问题。

The historical foundation of British Common Law

The common Law is a special concept of Anglo-American Law and an important historical foundation for all the regions and countries in the modern Common Law family. In recent years, with an increasing exchange between China and such countries and regions, the important value in researches on the Common Law has become visible. In China, however, the researches on the Common Law have been ignored for a long time and a few existing studies of the Common Law show a serious lack in covering its historical development and cultural context. Therefore, the article discusses above questions based on its original concept, historical status and the two important forming foundations.
