论侦查信息媒介

从认识论的角度而言,侦查即是一个认识的过程,是一个对案件逐步深入认识的过程。从同一认定视角入手,则侦查即是一个广义的同一认定的过程。侦查主体的未知性和侦查信息的可知性使得侦查信息媒介的存在成为必然。侦查信息媒介指的是侦查活动中侦查主体与相关人和物进行沟通以求获得信息所凭借的载体。侦查信息媒介分为言辞媒介和技术媒介,二者在本质、运用媒介和效益上存在着显著的差异。侦查信息媒介面临着相应的困境,包括言辞媒介和技术媒介自身的不稳定性和运用过程中滋生的冲突。侦查信息媒介应该从依赖言辞媒介转向以技术媒介为主,并相辅相成。

On the Media of Investigation Information

From the angle of epistemology,investigation is the process of understanding a case in depth gradually.Investigation is the process of identity determination in a broad sense.The uncertainty of the investigation subject and the knowability of the investigation information make it necessary that the investigation information media exist.The media of the investigation information refer to the carrier by which the investigation subject communicates with the related people for information.The media of the investigation information can be classified into language medium and technological medium,the two of which have differences in nature,application of vehicle and effect.We should take the technological medium as the dominant factor,but not depending on the language medium.
