| 摘 要： | 法学界对法律价值理解出现偏差 ,造成这种偏差的原因是 :法律价值概念本身的复杂性和各种错误观念的影响以及所属术语上的约定俗成等因素导致的 ,其表现在于法学界把法律价值与法律具体价值 (如法律价值标准、法律价值目标 )混为一谈 ;将经济学中价值理论照搬到法律价值理论上来 ;法学理论界对西方法哲学著作翻译时用词混乱。法律价值再思考 ,是通过语义上来重新界定法律价值 ,即法律价值是主体通过认识、评价和法律实践促使法律适应和服从主体的内在尺度而形成的法律对主体的从属关系。在内容上是通过对法律价值的属性 ,即法律价值主体性、客观社会性、伦理性、以及法律价值与法律主观的同一性来进一步阐释法律价值的内涵

| Abstract: | Because of the complicated conception on the value of law and the influence of wrong ideas,there exist mang deviations in the law frield on the value of law .This article offers a new defination of the value of law by comparing the value of law with the value of morals.It also analyses the features of the value of law and gives an explanation of its connotation further. |
