| 摘 要： | 两大法系国家的证据制度具有相当大的差异,世界著名证据法学者达马斯卡所著的《漂移的证据法》对此作出了深刻的比较研究。这种比较研究对我国证据制度的建构和完善不乏启发意义。英美国家具有独立的证据法,大陆法国家则倾心于法官的自由心证,而缺乏独立的证据法。我国应当实行规范证明和自由证明的混合制度。
