双重视角下虚拟财产的权利解读

虚拟财产作为网络经济发展的产物,在现有的财产权保护理论中处于尴尬的地位,对虚拟财产的保护出现了盲区。以法学与经济学双重视角进行分析,在现有的法学理论中提炼虚拟财产的基本属性,结合经济学基本原理,特别是其基础性理论——产权理论进行分析,在产权理论中给予虚拟财产以权利束的理论匡定,进而进行制度架构,对虚拟财产进行规范与保护。

An Interpretation on the Fictional Property Right in a Dual Visual Angle

The fictional property is a product of the economic development of network. It is in an awkward position in the existing theory of protecting the property right. The blind areas has appeared in the protection of the fictional property. Making an analysis in a dual visual angle of law science and France's economics, we refine the basic attribute of the fictional property in the existing law science theory, combine the basic principle of economics, especially its basic theory -making an analysis of the property right theory, rectify the theory of the fictional property, and then build up the system to standardize and protect the fictional property.
