| 摘 要： | 刑法对侵犯著作权罪的规定与著作权法存在不协调与不衔接之处,要完善立法,可以将原有的叙明罪状修改为空白罪状,充分利用空白罪状之利,并且将具体犯罪构成要件的参照依据限定为著作权法,以减少空白罪状之弊。

| Abstract: | there is incoordination between the crime of infringing copyright in criminal law and the copyright law.One way to perfect the legislation is to revise the original narrative facts about the crime of infringing copyright to blank facts and fully take advantage of latter.The reference of the concrete constitutive elements of crime should be limited to the copyright law,which could lessen the shortcoming of adopting the blank facts about the crime. |
