| 摘 要： | 商事营业国家干预原则主要有四个方面的本质规定性 ,其中最为重要的是该原则必须支持商事营业和保障社会公平。同时该原则也强调多元的利益集团的存在与商法的部门法化乃为其赖以存在的基础。深刻地认识该原则 ,也会有助于中国的商事法治建设。
