论我国空间权法律制度之完善

随着土地利用的立体化，土地空间权利观念和空间权法律制度在西方各国相继建立。而我国无论在土地立体利用的实践层面，还是在土地立体利用的立法层面，都处于相对落后状态。空间权的性质应为对一定空间上所设定的各种空间权利的抽象概括；空间权的体系应包含空间所有权和空间利用权。我国应当更新立法的基本思路，将“空间”明确规定在“物”的定义中，在“所有权”一章中设立空间所有权，设立独立的空间地上权，完善对权利冲突的协调，建立空间权登记制度。
