中国-东盟自由贸易区争端解决机制的构建初探

争端解决机制的建构是中国-东盟自由贸易区制度建设的重要内容,目前中国和东盟正在就此进行紧张的谈判磋商,但学界对之的研究还不多.本文探讨了两个基本问题:首先,从必要性和可能性两方面论证了中国-东盟自由贸易区应该定位于独立性、司法性的争端解决机制;其次,在中国-东盟自由贸易区与WTO争端解决机制的关系协调上,认为要在赋予成员国争端解决选择权的同时做出适当的限制,另外在适当范围内还可赋予该机制更大的权限.

Construction of CAFTA's Dispute Settlement Mechanism

The buildup of the dispute settlement mechanism, which is still in hot negotiation, is a major component of the construction of CAFTA. It's necessary and possible to make this mechanism an independent and judicial one. And to coordinate the action of this mechanism and that of WTO, it should have appropriate limitation on the right of its member to choose and allow a wider jurisdiction of the mechanism in some areas.
