| 摘 要： | 我国的商品房预售制度存在着诸多问题，预售资金的处理是其中之一。国家可在有关预售款的制度设计中引入第三方，采用托管与监管相结合的方式处理。通过对预售款托管制度的设计和间接监管手段的加强，借助法律的规制手段调控预售市场，使其能健康发展，并发挥出应有的积极作用。

| Abstract: | There are some problems existing in the present house presales system, and one of which is the dealt with the funds. The government can introduce a third party in the present system, and deal with it by combining trust and supervision. We can enable it to a healthy development and make it play an active role through strengthening the design on presale trust system and indirect supervision means, and controlling on the presale market with legal regulation means. |
