| 摘 要： | 环境侵害行政补偿制度是环境侵害救济社会化制度构建的重要内容,目的在于解决在环境侵害事件中责任主体缺位和履行不能情况下受害者的救济问题。在探索环境侵害行政补偿制度的构建准则、基本法律要素等问题的基础上,我国可以通过修改调整《排污费征收使用管理条例》的方式,尝试推行该项制度。

| Abstract: | Administrative compensation system of environmental damage is an important content for the construction of socialization relief system of environmental damage, the purpose of which is to solve victims＇ relief problems in environment damage issues in the absence of liability subject and under the condition of its inability to perform. Based on exploring the system issues such as construction rules and basic legal factors, we could try to promote the administrative compensation system by means of amending and adjusting Management Regulation of the Collection and Use of Sewage Charge |
