我国刑事司法中法律评价与道德评价的冲突论

本文从刑事法律与道德的一般关系出发,阐述了刑事司法中法律评价与道德评价的关系,认为道德评价对司法人员的法律评价存在着一定的影响;文章分析了刑事司法中的法律评价与道德评价冲突的原因和方式,认为刑事法律评价与道德评价的冲突实质上是法律文化与道德文化的冲突,这种冲突在我国司法实践中有三种不同的表现方式;文章同时分析了司法实践中对于刑事法律评价与道德评价冲突的二种不同的协调方式及其利弊。

An Analysis of Conflict Between Criminal Law Evaluation and Moral Evaluation in China''''s Criminal Jurisdiction

This paper demonstrates,from the standing point of the general relationship between criminal law and morality,the relationship between legal evaluation and moral evaluation in criminal jurisdiction,with the view that moral evaluation affects judicial functionary upon moral evaluation.The paper makes a further analysis of the cause and mode leading to the conflict between criminal law evaluation and moral evaluation,holding that the conflict between criminal law evaluation and moral evaluation is in its real sense the conflict between legal culture and moral culture.The conflict of the kind has given rise to three modes in China's judicial practices.The author has also given an analysis of the ad- vantages and disadvantages arising from the conflict.At the same time,two ways to coordinate the conflict have been put forward.
