| 摘 要： | 《刑法》第六十七条、第一百三十三条分别规定了自首、交通肇事罪,其核心点是对于交通肇事罪中没有逃逸者主动到公安机关投案,如实交代罪行的,能否认定为自首,目前对此行为的认定持有两种不同的观点,即认定为法定告知义务和认定有自首情节两种观点。对认定为有自首情节的观点进行理论论证和要件分析迫在眉睫。

| Abstract: | Articles 67 and 133 of the Criminal Law stipulate surrender and traffic accidents.Two different opinions exist regarding the recognition of surrender when the accident maker gives himself up to the police.This article makes a theoretical analysis against such recognition. |
