论浪费人

拉丁法律术语prodigus(浪费人)指的是那些寅吃卯粮的人。从《十二表法》到现代民法,设立浪费人制度的目的、行为模式、调整方法都相应地发生了变化。制度目的由原来的保存财产演化到尊重意思自治;行为模式由原来的笼统的挥霍浪费演化到具体的吸毒、赌博与酗酒;调整方法由原来的抽象的方法演化到具体的方法。
