| 摘 要： | 我国刑法将侵占特定款物的行为纳入贪污罪 ,挪用特定款物的行为按犯罪目的不同划分为挪用公款罪和挪用特定款物罪两种罪行而区别适用刑罚并将挪用特定款物罪归类于侵犯财产罪的立法模式不妥当 ,应专设侵占特定款物罪和挪用特定款物罪并将其归类于贪污贿赂罪之中。侵占特定款物罪与贪污罪、挪用特定款物罪与挪用公款罪是有明显区别的

| Abstract: | It is not proper to classify the conversion of limited funds and materials into crime of embezzlement, the appropriation of them into crime of violation of property, and the crime of conversion and appropriation of limited funds and materials should be set down ,and be included in the crime of embezzlement and bribery. Meanwhile a distinction should be made among the concerned crimes. |
